"The following was retrieved from Denark's , employment application If you are an attorney, you will easily spot the errors that are made, and some of the suppositions in this particular phrasing of language that are odd or possibly in violation of TN statutes: I understand that this application is not a contract of employment and that if hired, regardless of any oral representations to the contrary, the employment relationship between me and Denark is terminable-at-will so that both Denark and I remain free to choose to end our work relationship at any time for any or no reason. Changes in this employment relationship are only valid if made in writing by the CEO or President of Denark. I understand that all Denark offers of employment are conditional upon passing a drug and/or alcohol test and that a health evaluation by a doctor selected by Denark to determine whether I can perform the essential job duties, with or without a reasonable accommodation, may condition any offer of employment. I authorize Denark to make a thorough investigation of my past employment, education, job-related activities, and criminal records and I release from all liability all persons, companies, and corporations supplying such information. Further, I indemnify Denark against any liability that might result from making such an investigation. I authorize any employer, individual, school or organization identified in my application or related documents to provide Denark with the relevant information that may be used in the hiring decision and I release from liability and hold harmless any such persons, employers or organizations from legal liability in making such statements. The business needs of Denark may make the following mandatory: overtime, rotating schedule, or a work schedule other than Monday-Friday. Regular, predictable and punctual attendance is an essential function of any position with Denark. I authorize Denark to supply my employment record, in its sole discretion, in whole or in part, to any prospective employer, government agency, or other party, with an interest that Denark deems appropriate. I release any person, company or entity listed on my application. I agree that any claim or lawsuit relating to my service with Denark must be filed no more than six (6) months after the date of the employment action that is the subject of the claim or lawsuit.
