"despite being told on four occasions by phone that as long as the documentation was provided, anyone could pick an item up. I redeemed the item two weeks earlier with exactly the same documentation which was in another persons name. A check of the legislation and the advice from the employee both confirmed that this was fine by the legislation. I paid all but a dollar to hold the washing machine until I could arrange for it to be picked up. I rang the day before to ensure there were no problems with having the item picked up and was told that it was OK as long as the documentation was provided. The documentation was provided by the two gentlemen I had engaged to pick up the machine. It was in exactly the same condition as it was when the item was redeemed. Despite this and assurances only the day before Cash Converter staff refused to release the machine. The documentation was torn as it was the day I redeemed the machine. But despite the assurance that anyone could pick up the machine this was not the case. I had been told by phone on four occasions that there is no issue legislatively with someone else picking up the machine and indeed if I could have carried it on my back two weeks ago and paid the extra dollar,I could have taken it then. Cash Converters could have rung me to confirm that I had sent the people to pick up the machine. Instead they insisted on me going there in person and standing at the counter with the exact same documentation that the other two people had. These people had to drive back to me and take me in their vehicle just for this power crazed purpose. I had to pay an extra $20 for the addition time and effort this took to pick up the machine. Apparently by me standing at the counter instead of talking on the phone and with the same documentation, this somehow made a difference in the incompetent minds of the staff. I challenge Cash Converters to show me any legislation that stipulates that I (although not the original signatory either) had to travel to their premises in order for documentation, that they told me over and over was sufficient, before they could release the washing machine. Perhaps the manager can understand how ridiculous this is and accept that the staff were wrong and reimburse me $20 cost caused by bad staff. As well as documentation from Cash Converters, I provided the original purchase history from Harvey Norman. It was OK for Cash Converters to accept goods that did not belong to the person who pawned them just on her say so, yet the actual documentation was not accepted on the second occasion because it was torn, as it was on the first occasion. If I don't hear from the manager or owner I will take this to fair trading. At the very least some staff need to be trained better, as at least one or maybe two have an idea of the legislation but certainly not all of them. In case they are interested here is the relevent legislation for these incompetent people. Presumption of right to redeem (1) This section applies if a person asks to redeem property taken as a pawn by a pawnbroker and the person gives the pawnbroker a pawn ticket or a replacement pawn ticket for the property. (2) The person is taken to be the owner of the ticket or to be acting under the authority of the owner. (3) The person has a right to redeem the property unless— (a) the property has been seized under the FTI Act or by a police officer, and has not been returned to the pawnbroker; or (b) before the pawnbroker gives the person the property, the pawnbroker is informed— (i) by another person claiming to be the owner of the ticket that the ticket has been lost or taken without the other person’s consent; or (ii) by a credible person that the property has been stolen. Does anyone see any mention of torn documentation?????"
