"My brother was unjustly harassed on multiple visits and grabbed physically by a security guard, who without justifiable cause to believe, accused him of stealing—in front of my nieces, no less—overstepping Carniceria Mexico LLC’s (CM) privilege.  Although the guard apologized eventually, I would urge Carniceria Mexico LLC and its members, jointly and severally, to take notice: Did the guard commit assault under the Ariz. Rev. Stat. §§ 13-1203 (A)(2), 13-1203(3), a Class 1 Misdemeanor, when placing someone in reasonable apprehension of imminent physical injury; or knowingly touching someone with the intent to injure, insult or provoke such person?  Would there be false imprisonment and IIED, vicarious liability, and negligent hiring, training and/or supervision claims at play under state definitions, when CM’s security officer’ sole intent was to assume custody of him—even without physical injury?  Does CM condone these measures—albeit for risk assessment or other reasons—when its customers are victimized and harassed without evidence of wrongdoing? Accordingly, there are genuine issues of material facts, fitting the profile for the guards’ misconduct that CM should address."
