"Based on my experiences with Vial Fotheringham, I cannot recommend them as a law firm. Starting in 2015, Vial Fotheringham (VF) represented my HOA in a dispute over fees. The first VF attorney and I agreed on a settlement amount ($400) and exchanged drafts of an agreement. Then the first attorney suddenly left VF and Brindee Collins took her place. Ms. Collins refused to acknowledge the settlement or negotiate with me. I tried contacting her multiple times by phone and email, but she never responded. After six months of hearing nothing from her, I filed a motion to dismiss for lack of action. Ms. Collins did not respond to my motion, either. A few months later, after the judge informed us of her intent to dismiss the case, Ms. Collins finally responded to my motion. The case was dismissed anyway. That was in 2017. I did not hear from VF again for two years. In 2019, Carrie Knight called to demand payment. I explained to Ms. Knight that I had negotiated a settlement with VF (she called that “hearsay”) and that their case against me had been dismissed (she was unaware of that fact.) So, I started settlement talks with VF again. I spoke to one lawyer, but she left VF. I think my case was then handed to someone else before finally coming to rest with Greg Coxey. Mr. Coxey and I agreed to the same settlement amount: $400 plus any past-due fees. Unfortunately, we did not agree on the amount of past-due fees. I emailed them a breakdown of how I had calculated the past-due fees and asked them to work with me to resolve the discrepancy. I did not hear from them again until they filed a new action against me in 2020. I hired an attorney. We settled the case in 2021 for $400, using my calculations of back due HOA fees. Vial Fotheringham paid to have the liens on my property removed. TLDR: VF could have settled my case in 2015 (and 2019). Instead, it took six years, five attorneys, and two court cases for them to settle on the same agreement in 2021 that we had in 2015."
"Jennifer Freeman has committed a number of illegal business practices that have been documented and reported. She is just as ugly on the inside as she is on the outside. What a sad, pathetic human. She will be exposed once all the complaints to the county and BBB have been investigated."
"The most unprofessional place I have ever dealt with. Jennifer should not work in any industry that involves talking to people."
"Can’t agree more with the negative comments on here. Jennifer is the person that was assigned to my case and garnishment. She has no heart, no empathy, didn’t even want to hear me out. The second time I spoke with her she hang up on me. Very good at accusing. Won’t answer the calls, never calls back. My x has been calling and trying to make a payment in full, leaving messages, nothing… But every day that goes buy and if this debt in not paid it collects more fees. Will report them higher up."
"Should be a zero star review for this company. They are thieves who use the power of law and scare tactics to get people to pay collections. I was sent to them via local HOA for fees due of 900 dollars. When I contacted VF law to make a payment they have included attorney fees of 2900.00 for filing paperwork. When I requested the breakdown of their services they were unable to produce the documentation instantly. Each time they were contacted to follow up on the situation they made excuses and made sure to let me know the balance was increasing but I could not be told by what amount or for what reasoning. It took over 3 weeks and multiple emails to get the documentation that was requested, and when it was sent it was outdated by 3 weeks. Meaning the balance had increased (with more undocumented or unexplained charges) and more threatening letters were sent as a result. They took the time to file more motions without sending the information that was requested. I still have never received an accurate or explainable breakdown. They do not have a working online payment portal. When attempting payment you must call to get the balance first so you can call back the accounting department to pay. You must tell them how much you owe because they don't have documentation. Nothing feels right when dealing with this law firm. The neglect in responses, inconsistency in balances, no explanations and attitude that follows those requests makes it hard to belief they are not doing something wrong.
