"I live in Senator Carl Ford's district. He refuses to communicate with me. There is an error with NC’s Unemployment Benefits System that is causing many claimants to have their benefits unfairly denied for likely 20 years. The state law that applies in my case is this. 1. State law says for exclusion of unemployment benefits due to poor performance an employee must be given no less than three written reprimands in the twelve months prior to termination. [N.C. Gen. Stat. § 96-14.6(c)(11)]. 2. The term written reprimand is not listed in the list of defined terms for Unemployment insurance benefit laws. [N.C. Gen. Stat. § 96-1 Titles and Definitions]. My back story. I was fired from a major health system, Duke, in mid 2019 after my required training was canceled by HR. I failed three performance improvement plans which were based on work that could not be performed until near the time of my dismissal. The tasks were requiring vendor packages to be installed to complete the work. The vendor company did not disclose to us in advance what tasks they would be working on or when they expected to complete their packages. Basically, the work was impossible. According to HR, all that mattered was my two bad reviews that occurred as a result of the blocked training. I went through three hearings for state UI benefits starting in April 2020. I was denied each time. The authorities who presided over my hearings were interpreting any written communication to count as a written reprimand. These were in addition to the dates of my written warnings. These included the dates I was issued performance improvement plans and the dates of my performance improvement plans ending. A lawyer had warned me in 2007 that it was difficult to win UI benefits in NC. My former employer at that time chose not to contest my benefits. I don't have stats for this, but we have had residents in NC unfairly denied their State UI benefits since at least 2007. What needs to be done is to correct the law and retroactively award the benefits for all residents who were denied benefits due to this erroneous law. I suspect this will be thousands of claimants with a total payment of millions of dollars."
