"Asked for an exorbitant amount of money up front and then ended up accepted just over half that amount. Total waste of money and time. Sat 7 months on our family member's case trying to get a deal with the ADA who just ignored his phone calls. Never would hear from him, barely went to jail ever to visit. Would just keep telling us he's waiting to hear back from ADA as months passed by. He'd try again only when we bugged him incessantly only to get ignored again by ADA who obviously had no respect for him. Also not tech savvy at all, does not know even how to download a CD to make a .pdf to email you or put an attachment on an email, ultra frustrating and he's a one man show so good luck with that. After months of nothingness and feeling totally insecure with his defense, we let him go, hired another firm who had our family member out within 6 weeks. Bottom line, nice man who I believe has good intentions, totally ineffective. In response to ‘response from owner’ below: Regarding “much legal ground work had been performed prior to your family member’s case before the 3rd lawyer was hired”. That’s a joke since, though Mr. Fitzgerald may have put time into reviewing the case, etc the ONLY things Mr. Fitzgerald really did were to file a motion for a bifuricated jury trial (which was rejected by the judge), and to request a second bond hearing (only at our continual insistence) which came to nothing. The 3rd lawyer simply used the two doctor reports showing how very ill our family member was at the time of his arrest and all of that work was completed over 5 months before Mr. Fitzgerald was hired, by the first lawyer. The sentence our family member received ‘time served’ only happened because our 3rd lawyer insisted on changing the plea from “Not Guilty by reason of Insanity” and going to trial (several months away) which was the direction Mr. Fitzgerald was going, to “Guilty but Mentally Ill at the time” and having a sentencing hearing instead of a trial. I CLEARLY remember calling Mr. Fitzgerald to get his input on whether to go this new route suggested by the 3rd lawyer and he replied “NO, this is absolutely NOT the right way to go in this case, then you are saying he is guilty…etc. etc.” Thank God we did not listen to him and went with the advice of the 3rd lawyer and our family member was out 5 weeks later. That Mr. Fitzgerald reviewed over 10 discovery CD’s ? That’s hysterical because the state turned over only 8 CD’s. Claims that he met with the ADA at least 4 times in person ? when he would ask to meet with her her response was always “I don’t have time for this right now !!!!” which he’d cc us on. Mr. Fitzgerald received the discovery CD’s when he received the case in December 2018 and did not provide them to us until April of 2019 when I traveled there for a bond hearing (he said he had ‘no idea how to get them to me’, gee how about mailing them or ‘shocker’, downloading them to .pdf files and emailing them? He never showed them in entirety to our family member in jail because he didn’t bring his plug for his laptop and his laptop died after showing a couple of the videos. We kept begging him to go back with a charged laptop/plug to finally show them to our family member and he’d say, next week, next week, etc and it NEVER EVER happened. Saying he visited our family member at least 5 times in jail is totally inaccurate. Perhaps if he’s including the couple times he met him circumstancially in jail well before he was every hired while he was visiting other clients? He did meet with him once just before he was hired, and after that once that I know of to show him the CD’s which failed because his computer died. Regarding interviewing all of the state’s witnesseses ?? The state didn’t provide any witnesses except two that were listed on the police report and 1 other. I provided all the rest of the witnesses, names/descriptions on 5 pages and Mr. Fitzgerald only interviewed two people total, one that was on the police report R.H. and 1 that I provided M.T."
"Mr. Fitzgerald was hired to handle my sister in law case she had already been indicted on Felony charges and had been denied bond. We hired him, he went to visit her ON MEMORIAL DAY HOLIDAY and due to the Covid 19 court is only held Monday Wednesday and Friday but he got her released TUESDAY without a court appearance!!!! He definitely is an attorney in a cape!"
