N.H. DWI GUY

"I was charged with a dwi subsequent offense and thought I would just go in and plead guilty since I was guilty. The prosecutor told me he would give me the minimum 30 days in jail and a 3 year license loss. I would have lost my job if that happened so I got a public defender. He told me the best I could get is the 30 days in jail and 3 year license loss since that was the minimum penalty and if I went to trial and lost I could face a year in prison. I called the dwi guy for a second opinion. He told me if we went to trial one of the things the state had to prove for hgiher penalties is that there was a prior dwi. Since my prior wasn't in NH he might be able to argue it didn't count. I hired him and he was able to get it reduced to a 1st offense which kept me out of jail."
