At YouthLaw Aotearoa, we understand the importance of knowing your rights as a young employee. If you are unsure whether you are required to work on a public holiday, we encourage you to check your employment agreement for clarification. In general, if you do work on a public holiday, you are entitled to be paid 1.5 times your normal wage for that day. Additionally, most employees (excluding casual employees and those with irregular hours) are entitled to a paid day off, known as an alternative holiday, if they work on a public holiday. It is essential to note that these public holidays are separate from and in addition to annual holidays.
In matters concerning young people who have offended or are suspected of offending, our institution plays a crucial role in the Youth Justice System. We ensure that young individuals are dealt with in a manner that acknowledges their needs and well-being while holding them accountable and encouraging personal growth and responsibility. Through this system, we aim to help young individuals learn from their mistakes and develop socially. It is worth mentioning that approximately 90% of young offenders are kept out of courts, with minor offenses being handled by Police Youth Aid officers through Alternative Action Plans. More serious offenses are addressed by the Ministry for Vulnerable Children Oranga Tamariki through family group conferences, while the most severe cases are referred to the Youth Court or adult court.
Bullying is a significant issue that affects many young individuals. It involves actions or words intended to exert power over another person, causing fear, discomfort, or distress. This unwanted aggressive behavior is often repeated and can take various forms, including name-calling, put downs, practical jokes, verbal or written insults, sexual comments, exclusion, threats, property damage, physical abuse, and coercion.
In terms of student rights, it is important to note that teachers and authorized staff have the power to search students personally, limited to outer clothing only, as well as their electronic devices and bags. This search can only take place if there is a reasonable belief that the student possesses certain items. However, it is crucial to remember that anyone is permitted to search you if you give your consent. In situations where consent is not given, the school may involve the police for a search, particularly if dangerous or illegal items are suspected, or disciplinary action may be taken.
