"To all tenants, property owners (and agents!) I highly recommend the Renting Book, available through Legal Aid ACT Tenancy Advice Service (they also have a free tenancy advice line that connects you to a paralegal). This is a very clear concise publication documenting the rights and responsibilities of a tenant and simplifies the legislation set out in the ACT Residential Tenancies Act 1997. Under the legislation, property managers are required to manage properties according to these laws and ALL property managers should be across this legislation. Takeaway notes for owners AND tenants: An agent or landlord cannot simply “inform” a tenant they will be entering the property. Under the legislation this is a negotiated time with respect to (and requiring the agreement of) both parties. Signing the keys out to a third party without permission is not within the law (unless for urgent repairs). The vacate inspection must be done jointly, (unless either party agrees not to be there) and you must both sign and complete the condition report. Tenants must be given reasonable opportunity to be present, eg: an agent or landlord failing to attend an inspection at a time agreed to in writing, and informing a tenant they will be doing it the next day, is not giving a tenant reasonable opportunity under the legislation. Finally, to any property owners, ensure you are very clear on agency protocol and legislative knowledge. Are you getting what you are paying for, eg, are you happy with the tenant emailing some photos of your property to the agency and the property manager filling out a condition report off-site (and are the agency transparent in informing you of their inspection protocol)? The legislation is written to protect both tenants and property owners and I cannot recommend the above legal aid tenancy services and book enough (currently being updated to include the new end of tenancy legislation)."
