When it comes to property transactions, we understand the significance of thorough due diligence. If a material defect is discovered before settlement, the buyer has the right to claim compensation or terminate the contract. We also emphasize the importance of disclosing any tree applications or orders, as failure to do so grants the buyer the right to terminate the contract.
Additionally, sellers must provide a current Pool Safety Certificate prior to settlement. Failure to do so, or not obtaining a certificate at all, can result in a breach of an essential term, allowing the buyer to claim compensation and terminate the contract.
Lastly, if encumbrances appear on searches that were not disclosed in the contract, the buyer can exercise their rights to claim compensation and/or terminate the contract if they can prove that these encumbrances materially affect their use of the land.
