"This title company backed out of a closing that one of my sellers was doing. They said that they were not comfortable with the buyer paying the seller rent. The buyer was a tenant. Their premise was that, because it is a short sale, the buyer can not pay the tenant rent. They also claimed that having the buyer pay part of the agent commission was not ok because it had not been reported to the bank, even though the final HUD contained the information. At 11:00 AM the day of the closing they said that they just needed a letter from the seller correcting some closing conditions. At 12:00 I saw an email where they were saying that either myself, or the sellers title company (they did not specify which) was asking them to commit loan fraud. I emailed them to make sure they were clear on how the deal was working, and asked them to discuss their concerns with me. I also said that they were complicating a simple deal, and asked them not to continue. At 12:06 they emailed the parties to the transaction and said that they would no longer work with any of us. We went to another title company who had the deal completed and ready to go the same day. Do not work with someone who will pull out of a transaction with no notice, or explanation and leave everyone hanging."
