"NEW/EXISTING TENANTS A MUST READ - BE AWARE! THEY LOVE TO LIE AND STEAL YOUR MONEY ILLEGALLY! REFER TO "WHAT TO DO" FOR STEPS BELOW! RECAP OF OUR ISSUE: We vacated the apartment, after living there for a little over a year, 8 days before our tenancy ended. The apartment was empty, clean, and damage free, aside from any pre-existing damages. PER OUR REQUEST, Akeem from Avana did the initial inspection and by the way it was solely verbal. Akeem had a few remarks, yet all were pre-existing (photo proof was shown). A little over a month later, we received our Final Security Deposit Move-Out Statement indicating that they've deducted $379.71 for the following: $67.71 - Touch-Up Paint, $87.00 - Carpet Cleaning, and $225 - Unit Cleaning. We stopped by the office for an explanation, Akeem refused to explain, we tried calling the office (call was recorded with a warning) yet received same result. They kept pushing us off to their central office which made no sense, as they are responsible for the work and accountability. Prior to escalating this matter to their central office, I dug into the Leasing Agreement which led me to California Civil Code Law, discovering that all charges appear to be ILLEGAL. I wrote Akeem, Asheligh (Manager), and Courtney (Central Office) a lengthy letter demanding them to provide me photos of the damages, and a written explanation to validate each charge based on each section of their Leasing Agreement and the California Civil Code Law. They failed to do so. This matter eventually got escalated to the regional manager. A lot more can be said, yet to keep it short, overall the team there is very dishonest, careless, don't know their own Leasing Agreement Protocols, nor the law. They make things up on the fly (lying), and attempt to do everything they can just to weave away from refunding us the security deposits even after confronting them that those charges are illegal, and advising them of their legal obligations. After holding them and the regional manager under extreme pressure for 1 full month, they refunded us in full, and twice the security deposit amount on top for refunding us a tiny portion initially 39 days after we've vacated, instead of the "within 21 days" (Civil Code Section 1950.5(L)) as required by law. WHAT TO DO: 1. Vacate a week or so prior to your tenancy end date so you'd have time to do the initial inspection (if you request it), and remediate any damages/clean up if requested and law permits. (MAKE SURE TO RECEIVE A COPY OF AN ITEMIZED STATEMENT, AND SECURITY DEPOSIT STATUTE, VERBAL IS ILLEGAL). 2. Take Move In/Out Pictures if you can. 3. Carefully study the Leasing Agreement, specifically "Section 12 - DAMAGES, ALTERATIONS AND REPAIRS.”, "Section H: MOVE-OUT INFORMATION: MOVE-OUT CHARGES:" along with "Section 20. CLEANING" which clearly state that tenant is ONLY liable for damages BEYOND normal wear and tear along with certain other guidelines. 4. Carefully study California Civil Code Section 1950.5(F)(1)-(5), (G), (L) - Link to PDF: courts. ca. gov/partners/documents/InitialInspection.pdf - Court from the State Of California chews the law up in laymen terms with examples. 5. Write a letter explaining your concerns to Avana Vista Point Management and make sure to include sections from the Leasing Agreement, and Law for support. 6. Request photo proof, and explanation for each charge. If charges are bogus they simply won't have them, and won't provide them to you. 7. Hold them under extreme pressure and keep them accountable. Demand nearly daily updates with progress. They really love to cover up with many vague terms such as "we'll try our best", "it'll take some time" and much more. Demand clear timelines for every action they say/do and demand a follow-up after the fact. Recap every phone call in a form of an email immediately after the call regardless whether it was recorded (with a warning) or not. Best to keep email as your primary form of communication. 8. "After 8 weeks, I still didn't get back my security deposit. It's almost $900 . I'm getting tired of driving to the office, and they don't do nothing. Now I understand why Avana Vista Point has 3.1 star rating on Google and 2.6 stars on yelp. Please read all reviews before you decide to move to those apartments."
