"We wanted to build A Custom Barndominium on our property in Bandera Texas. The constructed building was built in the wrong location and had obvious structural and foundation issues. "*************Warning*********** If there was an option for a zero rating for Attorney James’ work, I would rate it as such. I hired Attorney James to represent me regarding a residential construction defect claim which included elements of both RCLA and DTPA. My biggest ire with Attorney James was the fact that she was intimidated by opposing counsel, relied on his direction, and more importantly colluded with him when he specifically asked her to non-suit the case. In addition, there was no contact nor communication from her for approximately 90 days. Had I not reached out to her, I would still be waiting for a response. When she was presented an attempt at a settlement offer, she sat on the offer approximately eight months. She also attempted to coerce me to accept a lower settlement by suggesting repeatedly that opposing counsel would force arbitration if I continued to move forward with specific monetary claims. She provided opposing counsel with erroneous costs related to attorney fees. Essentially listing a lower figure paid in legal fees compared to what was actually paid. When brought to her attention, she was lax about correcting. When presented with other financial losses to be reimbursed, she would state she could not ask for that amount but would never state what an acceptable amount would be or why the amount could not be reimbursed. Of course her recommendations would come after her consultation with opposing counsel. This behavior continued for approximately eight months. She along with opposing counsel intentionally delayed handling this claim. There was no legal strategy involved on her part. She accepted every directive of opposing counsel. Attorney James’ performance was merely that of an administration assistant at the pay scale of an attorney. She fielded calls and emails only. No legal strategy at all. When I requested to be cc’d on all email conversations between she and opposing counsel, she resigned. The day she resigned she finally admitted that opposing counsel had asked her to non suit the case. Although she didn’t non suit the case, the fact that she delayed the legal process, left me unrepresented, exposed, no financial compensation after approximately two years, and I was outside my statute of limitations, which is where opposing counsel wanted me to be.
